Establishment of representative offices of foreign publishing houses in Viet Nam must apply for license from MIC

Ministry of Information and Communications (MIC) issued Circular No 13/2011/TT-BTTTT on regulating establishment of representative offices (ref. offices) of foreign publishing houses and organizations in Viet Nam on June 6, 2011 . Accordingly, establishment of ref. offices of foreign publishing houses and organizations in Vietnam must apply for license from MIC. The circular is considered to be detailed guidelines for foreign publishing houses and organizations to set up a ref.office in Viet Nam and State management agencies in publication activity.

Establishment dossier must be made into 01 set in Vietnamese and one in English (Vietnamese version shall be accepted in case of difference between English and Vietnamese set) and directly sent or via postal and delivery services to the Publication Department.

Application dossier for establishment of ref. offices includes as follows:

      Application for establishment of ref. office;

    Official document of competent agency or person certifies that legal operation of foreign publishing house or organization in its headquarter- based nation;

      Certified copy or copy with original of office leasing contract in Viet Nam for ref.office or other alternative documents;

      Certified copy or copy with original for comparison of legal curriculum vitae that a competent agency issues for head of ref. office

Within 30 days since license granting date, ref. office shall report to the Provincial Department of Information and Communications where ref.office is located and have the following contents posted on 03 consecutive issues or days of newspapers or websites, legal published in Vietnam:

       Name, name, address, phone number, website (if any) of foreign publishing houses and organizations;

       Name, address and phone number of ref. office and other information (if any);

       Full name and nationality of the head of ref.office;

       Number, date of issuance, expiry date and issuance agency of license of establishment of ref.office, operation fields specified in license and start date of operation.

In addition, the circular also stipulates re-issuance, modification, supplement and renewal of license; situations to reject granting license for establishment of ref.office and withdraw license, responsibilities of foreign publishing houses/ organizations and State management agencies etc

This Circular comes into effect from September 1, 2011.
